1) General information only

All content on our website, products, platforms, APIs, documentation, blog posts, case studies, marketing materials and any communications we publish (collectively, the “Content”) is provided for general information and illustrative purposes. The Content is not tailored to your circumstances and must not be relied on as professional advice (including legal, financial, tax, investment, accounting, medical, HR, or technical advice). You should obtain independent professional advice before acting on any information.

Nothing on the Website or within the Solution constitutes an offer, recommendation, solicitation, invitation, promotion, prospectus or advice to buy or sell any product, service, security, or to enter into any transaction. 3) AI-generated outputs and human review

Some features may generate, summarise, classify, transform or otherwise produce machine-generated content (“AI Output”).

  • AI Output may be inaccurate, incomplete, outdated or inappropriate for your use case.

  • You are responsible for reviewing, verifying and validating AI Output and for using it at your own risk.

  • Do not rely on AI Output as a substitute for professional judgment or human review.

  • You are responsible for ensuring your use of AI Output complies with applicable laws, policies and third-party rights (including IP and privacy).

4) Availability, changes and accuracy

We aim to keep the Website and Solution available, secure and up to date, but do not guarantee:

  • uninterrupted or error-free operation;

  • that Content is accurate, complete, current or suitable for any purpose;

  • that defects will be corrected; or

  • compatibility with your devices, systems or browsers.
    We may change, suspend or discontinue any part of the Website, Solution or Content at any time without notice.

5) Security, data and multi-tenant architecture

We implement reasonable, appropriate safeguards; however, no system is 100% secure. You are responsible for your own security (including strong passwords, access controls and backups, unless otherwise agreed in a written services agreement).
For SaaS customers, each client is provisioned a logically (and where applicable, physically) segregated instance; we do not share data between client instances. While we take care to isolate tenants, you remain responsible for role assignments, permissions, and data you upload.

6) Third-party websites, services and links

The Website and Solution may contain links to third-party websites or integrate with third-party services. These are provided for convenience only. We do not control and are not responsible for their content, availability, security, accuracy, practices or policies. Your use of third-party services is at your own risk and subject to those third parties’ terms and privacy policies.

7) Intellectual property and fair use

All intellectual property in the Website, Solution and Content (excluding your own data) is owned by AI or our licensors. Unless permitted by law or an applicable licence, you may not copy, adapt, reverse engineer, scrape, frame, resell or otherwise exploit any part of the Website, Solution or Content without our prior written consent. Third-party names, logos and marks remain the property of their respective owners.

8) No client relationship

Your use of the Website, Solution or Content (including contacting us) does not create any advisory, fiduciary, attorney-client, auditor-client, or similar professional relationship between you and AI unless expressly recorded in a signed written agreement.

9) Limitation of liability

To the maximum extent permitted by South African law:

  • We are not liable for any indirect, special, incidental, punitive or consequential loss, or for loss of profits, revenue, opportunity, goodwill or data, arising from or related to your use of (or inability to use) the Website, Solution, Content, AI Output or third-party services.

  • Our aggregate liability for all claims is limited to the greater of (a) the total fees you paid to AI (if any) for the affected service in the 12 months preceding the event giving rise to liability, or (b) ZAR 10,000.

  • Nothing excludes liability for fraud or wilful misconduct, or any liability that cannot lawfully be limited.

10) Your responsibilities and indemnity

You are responsible for: (a) how you access and use the Website, Solution, Content and AI Output; (b) complying with applicable laws; and (c) ensuring your inputs, prompts, uploads and configurations are lawful and accurate.
You agree to indemnify and hold harmless AI, its directors, employees and agents from claims, losses, damages, costs and expenses arising out of or related to your breach of this Disclaimer or misuse of the Website, Solution, Content, AI Output or third-party services.

11) Forward-looking statements

From time to time we may make statements about planned features, performance, benefits or results. These are forward-looking and involve risks and uncertainties. Actual outcomes may differ. We undertake no obligation to update forward-looking statements.

12) Governing law and jurisdiction

This Disclaimer is governed by the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of South African courts in relation to any dispute arising from or connected with it.

13) Relationship to our Terms and Privacy Policy

This Disclaimer forms part of and should be read with our Terms of Use and Privacy Policy. If there is any inconsistency, the signed contract (if any) between you and AI prevails for the relevant service.

14) Changes

We may update this Disclaimer from time to time. The “Last updated” date will reflect the current version. Your continued use of the Website or Solution after changes take effect constitutes acceptance of the updated Disclaimer.
